VHQ Texas LLC ("VHQ," "we," or "us"), which operates the DTF Wholesale website and portal, respects intellectual property rights and expects its customers to do the same. This Policy explains how rights holders can report infringing material on dtfwholesale.com or portal.dtfwholesale.com, or products we printed, and how customers can respond. For customers, it is part of our Terms of Use and Artwork and IP Policy.

1Where to Send Notices

Send copyright notices to:

Copyright Agent
VHQ Texas LLC, operator of the DTF Wholesale website and portal
10827 Alder Cir, Dallas, TX 75238
Email: team@dtfwholesale.com (subject: "DMCA Notice")

2Notice of Claimed Infringement

2.1 If you believe material on our site or Portal, or a product we printed, infringes your copyright, send a written notice that includes:

(a) a physical or electronic signature of the rights holder or a person authorized to act for them;

(b) identification of the copyrighted work claimed to be infringed, or a representative list if there are several;

(c) identification of the material claimed to be infringing, with enough detail for us to find it, such as a URL, an order number, a photo of the product, or a description of the design;

(d) your name, mailing address, phone number, and email address;

(e) a statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law; and

(f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights holder or authorized to act for them.

2.2 Trademark and right-of-publicity complaints are not DMCA notices, but we accept them at the same address. Include items (a), (c), (d), and (e), the mark (with registration number, if any) or the person's name, and a statement that the information is accurate.

2.3 Under 17 U.S.C. 512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3What We May Do After a Notice

3.1 When we receive a notice that substantially complies with Section 2.1 or 2.2, we may remove or disable access to the material, hold or cancel open orders and reorders that use it, and ask the customer for proof of rights.

3.2 We may notify the customer and give them a copy of the notice, including the complainant's contact details.

3.3 We may keep related files and records as long as reasonably needed for the claim.

4Counter-Notice

4.1 If you are our customer and believe material was removed or an order was held or canceled because of a mistake or misidentification, you may send a counter-notice to the address in Section 1 that includes:

(a) your physical or electronic signature;

(b) identification of the material that was removed or disabled and where it appeared before removal, or the order number;

(c) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;

(d) your name, address, and phone number; and

(e) a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

4.2 When we receive a valid counter-notice, we forward a copy, including your contact details, to the person who sent the original notice. If that person does not tell us within 10 business days that they have filed a court action, we may restore hosted material in 10 to 14 business days after receiving the counter-notice.

4.3 A counter-notice does not require us to accept, reinstate, print, or ship any order. Our right to refuse jobs under the Artwork and IP Policy still applies.

5Account Suspension and Closure

5.1 We may suspend or close a customer's account after a valid infringement notice or complaint about that customer's material, without waiting for multiple notices. We may also do so if the customer will not provide proof of rights when asked.

5.2 We may refuse new accounts from people or businesses whose accounts were closed under this Policy.

6Changes

We may update this Policy by posting a new version with a new version number and effective date.
